Curis Terms and Conditions for Doctor (Specialist) Accounts

1. Introduction

1.1 Acceptance of Terms

By creating a Doctor (Specialist) account on Curis, you agree to these legally binding Terms and Conditions and affirm your compliance with applicable laws in Kenya.

1.2 Purpose of Service

Curis connects doctors with patients and healthcare institutions for professional consultation, diagnosis, and treatment tracking.

1.3 Effective Date

These terms are effective as of January 11th, 2025.

3. Account Terms

3.1 Registration Requirements

You must be a licensed and registered medical practitioner in Kenya.

3.2 User Roles & Permissions

Doctors are granted access to consult, create, and manage patient profiles, issue prescriptions, and document treatment records.

3.3 Account Security

You are responsible for maintaining the confidentiality of your login credentials.

3.4 Password Requirements

Passwords must be secure and changed regularly.

3.5 Two-Factor Authentication

You are required to enable and maintain two-factor authentication on your account.


4. Service Terms

4.1 Scope of Services

Doctors can access patient data (with consent), provide consultations, upload medical notes, and issue prescriptions.

4.2 Service Availability

Curis strives for 24/7 uptime, but availability is not guaranteed.

4.3 Service Modifications

We reserve the right to modify or suspend services with or without notice.

4.4 Maintenance Policy

Scheduled maintenance will be communicated in advance via in-app notifications or email.


5. User Responsibilities

5.1 Providing Accurate Information

All information, diagnoses, and records must be accurate, up-to-date, and professionally valid.

5.2 Responsible Use of Patient Data

You are legally bound to uphold confidentiality and secure handling of patient data under the Data Protection Act, 2019.

5.3 Prohibited Uses

You may not use the platform for fraudulent practices, misrepresentation of medical qualifications, or prescribing without examination.

5.4 Compliance With Medical Laws

All medical activities on Curis must comply with the Kenya Medical Practitioners and Dentists Council (KMPDC) regulations and other relevant laws.


6. Limitations & Liabilities

6.1 Warranty Disclaimer

Curis is provided "as-is" without warranties of any kind.

6.2 Liability Limitations

Citrus Labs Limited is not liable for any damages resulting from your use of the platform, including but not limited to misdiagnoses, missed consultations, or legal actions.

6.3 Service Interruptions

We are not responsible for delays, outages, or disruptions due to maintenance or third-party failures.

6.4 Third-Party Services

Use of integrated third-party tools is at your discretion and risk.


7. Intellectual Property

7.1 Platform Ownership

All platform content, features, and source code remain the property of Citrus Labs Limited.

7.2 User-Contributed Medical Content

You retain ownership of your medical content but grant us a non-exclusive license to use it for platform operations.

7.3 License Grant

You grant Curis the right to host, display, and use your content solely for service delivery.

7.4 Feedback Rights

All feedback you provide may be used without compensation to improve the platform.


8. Termination Rights

8.1 Termination by User

You may deactivate your account at any time by written request.

8.2 Termination by Curis

We reserve the right to suspend or terminate your account for breach of these Terms or applicable laws.

8.3 Effects of Termination

Access to all Curis services will cease immediately. Patient data must be transferred responsibly.

8.4 Data Retention After Termination

Your account data will be retained for up to 7 years to comply with medical records laws unless requested otherwise in writing.


9. Dispute Resolution

9.1 Governing Law

These Terms shall be governed by the laws of Kenya.

9.2 Arbitration Process

All disputes will be resolved through binding arbitration under Kenyan arbitration laws.

9.3 Dispute Notice Requirements

You must notify us in writing within 30 days of any dispute.

9.4 Class Action Waiver

You agree not to participate in any class action claims.


10. Changes to Terms

10.1 Modification Process

We may update these Terms periodically. Updates take effect upon posting.

10.2 Notification Methods

We will notify users via email or in-app alerts.

10.3 Continued Use Agreement

Continued use of Curis after changes implies acceptance of the updated Terms.
